Welcome to Deth-x (the "App"), a service provided by Deth-x LLC ("we," "our," or "us"), a subsidiary of Hex-Evo LLC. By downloading, accessing, or using our App, you agree to be bound by these Terms of Service and Privacy Policy (collectively, the "Agreement").PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS. BY ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY ALL TERMS DESCRIBED HEREIN. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE APP.
1. LICENSE GRANT AND RESTRICTIONS
1.1 License Grant
Subject to your compliance with the terms of this Agreement, Deth-x LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on a device that you own or control and that meets our system requirements.
1.2 License Restrictions
You may not:
- License, sell, rent, lease, transfer, assign, distribute, or otherwise commercially exploit the App;
- Modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the App;
- Access the App in order to build a similar or competitive product or service;
- Copy, reproduce, distribute, republish, download, display, post, or transmit the App except as expressly permitted;
- Remove or alter any proprietary notices or labels on the App;
- Use the App for any illegal purpose, or in violation of any local, state, national, or international law;
- Use automated scripts to collect information from or otherwise interact with the App.
2. DATA COLLECTION AND PRIVACY
2.1 Types of Data Collected
The App may collect the following types of information:
- Account information (email address, username, password);
- Device information (device type, operating system, unique device identifiers);- Usage information (features accessed, time spent on App, crash reports);
- Location information (with your permission);
- Social media account access (with your explicit authorization);
- Other information you choose to provide.
2.1.1 Data Storage Architecture
Your personal information and user data are stored within our proprietary Data Vault system, which is specifically designed to isolate and protect your information. This system employs enhanced security measures beyond standard industry practices and maintains your data separately from operational systems used for day-to-day app functionality.
2.2 Use of Data
We use the data we collect to:
- Provide, maintain, and improve the App;
- Develop new products and services;
- Personalize your experience;
- Process transactions;
- Send you technical notices, updates, and support messages;
- Respond to your comments and questions;
- Protect against fraudulent, unauthorized, or illegal activity.
2.3 Data Sharing and Disclosure
We may share the information we collect in the following circumstances:
- With service providers who perform services on our behalf, subject to strict contractual limitations on their use and access to your data;
- To comply with legal obligations, such as court orders, subpoenas, or as required by applicable laws;

- In an aggregated and/or anonymized form that cannot reasonably be used to identify you.
2.3.1 Restricted Data Flow Controls
Deth-x employs one-way data flow controls designed to prevent the automatic or passive sharing of your personal information with third-party providers, including platform providers like Apple, Google, or Microsoft. These technical controls help ensure that your data remains within our secure environment and is not automatically accessible to third parties without your explicit consent or knowledge, except where technically
required for basic app functionality or as legally required.
2.4 Data Aggregation
We may compile, analyze, and create aggregated, anonymized data sets ("Data Encyclopedias") derived from user data. These Data Encyclopedias contain high-level, non-personally identifiable information and may be sold or licensed to third parties. At no time will your personal profile or individually identifiable information be sold or shared without your explicit consent.
2.5 Artificial Intelligence
The App utilizes artificial intelligence technologies to enhance user experience and functionality. These AI systems may process user data to provide personalized features and improve App performance. All AI processing complies with the data practices outlined in this Agreement.
3. INTELLECTUAL PROPERTY
3.1 Ownership
The App, including all intellectual property rights therein (including without limitation any and all patents, patent applications, trademarks, copyrights, trade secrets, and other proprietary rights), is and will remain the property of Deth-x LLC and its licensors. This Agreement does not convey to you any rights of ownership in or to the App, or any intellectual property rights therein.
3.2 Patents and Related Rights
The App and its features are protected by various patents and patent applications owned by or licensed to Deth-x LLC. Nothing in this Agreement shall be construed as granting you any rights or licenses to any patents or patent applications related to the App or its technologies. All rights not expressly granted herein are reserved by Deth-x LLC and its affiliates.
3.3 Feedback
Any feedback, comments, or suggestions you may provide regarding the App is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.
4. USER CONTENT AND SOCIAL MEDIA INTEGRATION
4.1 User Content License
By submitting, posting, or displaying content on or through the App ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.
4.2 Social Media Brokerage Services
The App functions as a brokerage service that can post content to third-party social media platforms on your behalf. By connecting your social media accounts to the App, you expressly authorize and instruct Deth-x LLC to:
- Access your social media accounts using the credentials you provide;
- Create, modify, delete, and publish content to your connected social media accounts;
- Interact with other users and content on those platforms on your behalf;
- Retrieve analytics and engagement data related to your social media presence.
You acknowledge that each social media platform has its own terms of service, privacy policies, and community guidelines, and you remain responsible for complying with these third-party terms when using our App to post to these platforms.
4.3 Social Media Platform Permissions
Access to your social media accounts requires your explicit permission through each platform's authentication process. Different levels of functionality may require different permission levels, which will be clearly indicated during the authentication process. You can revoke these permissions at any time through the App settings or directly through your social media platform account settings.
You understand that by revoking permissions, certain App features may no longer function properly. Deth-x LLC is not responsible for any consequences resulting from your decision to revoke permissions, including but not limited to scheduled posts that fail to publish, incomplete analytics, or other service disruptions.
4.4 User Content Representations
You represent and warrant that: (i) you own the User Content or have the right to grant the rights and licenses in this Agreement, (ii) the User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person, and (iii) you have the legal authority to authorize Deth-x LLC to post content to your social media accounts.
5. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Deth-x LLC, Hex-Evo LLC, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, your violation of this Agreement, or your violation of any third-party rights.
6. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DETH-X LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DETH-X LLC MAKES NO WARRANTY THAT: (I) THE APP WILL MEET YOUR REQUIREMENTS, (II) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE APP WILL MEET YOUR EXPECTATIONS.
6.1 Errors, Mistakes, and Premature Content Release
DETH-X LLC DOES NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INFORMATION, OR DATA PROVIDED THROUGH THE APP. YOU ACKNOWLEDGE THAT CONTENT MAY BE RELEASED OR DISPLAYED PREMATURELY, CONTAIN ERRORS, INACCURACIES, OR MISTAKES, AND YOU AGREE THAT YOU RELY ON SUCH CONTENT AT YOUR OWN RISK. DETH-X LLC IS NOT RESPONSIBLE OR LIABLE FOR ANY DECISIONS MADE BASED ON SUCH CONTENT.
6.2 Data Security and Protection
6.2.1 Data Security Architecture
Deth-x employs a proprietary "Data Vault" security architecture designed to provide enhanced protection for your personal information. Our system is specifically engineered with one-way data flow controls that prevent passive or unauthorized sharing of your data with third-party service providers, including platform providers.
Your personal information and user-entered data are stored in encrypted form within our secure Data Vault, which is designed with multiple layers of security controls and access restrictions. We implement industry-standard and advanced security measures including but not limited to: encryption at rest and in transit, multi-factor authentication, access controls, regular security assessments, and continuous monitoring for suspicious activities.
6.2.2 Data Isolation Commitment
Unlike many applications, Deth-x is designed to minimize data exposure to third parties. We commit to:
- Not passively sharing your user-entered information with platform providers beyond what is technically required for basic app functionality
- Maintaining strict data separation between your personal information and any third-party services we utilize
- Providing you with transparency and control over what data is collected and how it is used
- Regularly reviewing and limiting the permissions and access rights of any integrated services
6.2.3 Security Limitations
WHILE DETH-X LLC IMPLEMENTS ADVANCED SECURITY MEASURES TO PROTECT USER DATA AS DESCRIBED ABOVE, WE CANNOT GUARANTEE ABSOLUTE SECURITY. YOU ACKNOWLEDGE AND AGREE THAT DETH-X LLC SHALL NOT BE LIABLE FOR ANY DATA BREACHES, UNAUTHORIZED ACCESS, OR OTHER SECURITY INCIDENTS THAT ARE BEYOND ITS REASONABLE CONTROL. IN THE EVENT OF A DATA SECURITY INCIDENT, DETH-X LLC WILL COMPLY WITH APPLICABLE LEGAL REQUIREMENTS REGARDING NOTIFICATION AND TAKE APPROPRIATE STEPS TO CONTAIN AND REMEDIATE THE INCIDENT.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DETH-X LLC, HEX-EVO LLC, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
7.1 Personal Safety and Well-being
YOU ACKNOWLEDGE AND AGREE THAT DETH-X LLC IS NOT RESPONSIBLE FOR ANY PHYSICAL, MENTAL, OR EMOTIONAL HARM, INJURY, DISTRESS, OR DAMAGE THAT MAY RESULT FROM YOUR USE OF THE APP. THE APP IS NOT DESIGNED TO PROVIDE MEDICAL ADVICE, MENTAL HEALTH TREATMENT, CRISIS INTERVENTION, OR SUICIDE PREVENTION SERVICES. IF YOU ARE EXPERIENCING A MEDICAL OR MENTAL HEALTH EMERGENCY, PLEASE CONTACT A QUALIFIED MEDICAL PROFESSIONAL, CALL YOUR LOCAL EMERGENCY SERVICES, OR VISIT YOUR NEAREST EMERGENCY ROOM IMMEDIATELY.
UNDER NO CIRCUMSTANCES SHALL DETH-X LLC BE LIABLE FOR ANY SELF-HARM, SUICIDE, OR DEATH THAT MAY OCCUR IN CONNECTION WITH THE USE OF THE APP, REGARDLESS OF WHETHER SUCH HARM WAS FORESEEABLE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR WELL-BEING AND SAFETY WHILE USING THE APP.
8. DISPUTE RESOLUTION AND ARBITRATION
8.1 Binding Arbitration
You and Deth-x LLC agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof or the use of the App shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
8.2 Class Action Waiver
YOU AND DETH-X LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
8.3 Governing Law
This Agreement shall be governed by the laws of [YOUR STATE] without regard to conflict of law principles.
9. TERMINATION
9.1 Termination by You
You may terminate this Agreement by deleting the App from your device and discontinuing all use of the App.
9.2 Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the App will immediately cease.
9.3 Effect of Termination
The following provisions will survive termination of this Agreement: Intellectual Property, Indemnification, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution and Arbitration, and any other provision that by its nature should survive termination.
10. RELATIONSHIP BETWEEN DETH-X LLC AND HEX-EVO LLC
Deth-x LLC is a wholly-owned subsidiary of Hex-Evo LLC. All licenses, permissions, and authorizations granted to Deth-x LLC under this Agreement are provided pursuant to Deth-x LLC's operational authority as delegated by Hex-Evo LLC. Notwithstanding the foregoing, Deth-x LLC is the sole party responsible for all obligations, representations, warranties, and liabilities under this Agreement. All claims, causes of action, or disputes arising out of or relating to this Agreement or the App shall be directed solely to Deth-x LLC and not to Hex-Evo LLC or any of its other subsidiaries or affiliates.
11. COMPLIANCE WITH APP STORE TERMS
The App may be subject to additional terms and conditions imposed by third-party app platforms or marketplaces (e.g., Apple App Store, Google Play Store) through which you access or download the App. You agree to comply with all applicable third-party terms and conditions when using the App.
12. MODIFICATIONS TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Agreement.
13. MISCELLANEOUS
13.1 Entire Agreement
This Agreement constitutes the entire agreement between you and Deth-x LLC regarding the App and supersedes all prior and contemporaneous written or oral agreements.
13.2 Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Deth-x LLC.
13.4 Assignment
You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer this Agreement without such consent will be null and void. We may freely assign or transfer this Agreement without restriction.
13.5 Refunds and Goodwill Gestures
Any refunds, reimbursements, credits, complimentary services, public relations gestures, public statements, or other accommodations provided by Deth-x LLC to users are offered purely as a gesture of goodwill or for customer satisfaction purposes. Such actions shall not constitute and shall not be construed as an admission of fault, liability, wrongdoing, or responsibility for any issues, incidents, or claims. Deth-x LLC explicitly reserves all rights and defenses regardless of any such goodwill gestures provided.

DETH-X LLC MAKES NO WARRANTY THAT: (I) THE APP WILL MEET YOUR REQUIREMENTS, (II) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE APP WILL MEET YOUR EXPECTATIONS.

YOU ACKNOWLEDGE THAT CONTENT MAY BE RELEASED OR DISPLAYED PREMATURELY, CONTAIN ERRORS, INACCURACIES, OR MISTAKES, AND YOU AGREE THAT YOU RELY ON SUCH CONTENT AT YOUR OWN RISK. DETH-X LLC IS NOT RESPONSIBLE OR LIABLE FOR ANY DECISIONS MADE BASED ON SUCH CONTENT.
6.2 Data Security and Protection
6.2.1 Data Security Architecture
Deth-x employs a proprietary "Data Vault" security architecture designed to provide enhanced protection for your personal information. Our system is specifically engineered with one-way data flow controls that prevent passive or unauthorized sharing of your data with third-party service providers, including platform providers.
Your personal information and user-entered data are stored in encrypted form within our secure Data Vault, which is designed with multiple layers of security controls and access restrictions. We implement industry-standard and advanced security measures including but not limited to: encryption at rest and in transit, multi-factor authentication, access controls, regular security assessments, and continuous monitoring for suspicious activities.
6.2.2 Data Isolation Commitment
Unlike many applications, Deth-x is designed to minimize data exposure to third parties. We commit to:
- Not passively sharing your user-entered information with platform providers beyond what is technically required for basic app functionality
- Maintaining strict data separation between your personal information and any third-party services we utilize
- Providing you with transparency and control over what data is collected and how it is used
- Regularly reviewing and limiting the permissions and access rights of any integrated services
6.2.3 Security Limitations
WHILE DETH-X LLC IMPLEMENTS ADVANCED SECURITY MEASURES TO PROTECT USER DATA AS DESCRIBED ABOVE, WE CANNOT GUARANTEE ABSOLUTE SECURITY. YOU ACKNOWLEDGE AND AGREE THAT DETH-X LLC SHALL NOT BE LIABLE FOR ANY DATA BREACHES, UNAUTHORIZED ACCESS, OR OTHER SECURITY INCIDENTS THAT ARE BEYOND ITS REASONABLE CONTROL. IN THE EVENT OF A DATA SECURITY INCIDENT, DETH-X LLC WILL COMPLY WITH APPLICABLE LEGAL REQUIREMENTS REGARDING NOTIFICATION AND TAKE APPROPRIATE STEPS TO CONTAIN AND REMEDIATE THE INCIDENT.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DETH-X LLC, HEX-EVO LLC, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
7.1 Personal Safety and Well-being
YOU ACKNOWLEDGE AND AGREE THAT DETH-X LLC IS NOT RESPONSIBLE FOR ANY PHYSICAL, MENTAL, OR EMOTIONAL HARM, INJURY, DISTRESS, OR DAMAGE THAT MAY RESULT FROM YOUR USE OF THE APP. THE APP IS NOT DESIGNED TO PROVIDE MEDICAL ADVICE, MENTAL HEALTH TREATMENT, CRISIS INTERVENTION, OR SUICIDE PREVENTION SERVICES. IF YOU ARE EXPERIENCING A MEDICAL OR MENTAL HEALTH EMERGENCY, PLEASE CONTACT A QUALIFIED MEDICAL PROFESSIONAL, CALL YOUR LOCAL EMERGENCY SERVICES, OR VISIT YOUR NEAREST EMERGENCY ROOM IMMEDIATELY.
UNDER NO CIRCUMSTANCES SHALL DETH-X LLC BE LIABLE FOR ANY SELF-HARM, SUICIDE, OR DEATH THAT MAY OCCUR IN CONNECTION WITH THE USE OF THE APP, REGARDLESS OF WHETHER SUCH HARM WAS FORESEEABLE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR WELL-BEING AND SAFETY WHILE USING THE APP.
8. DISPUTE RESOLUTION AND ARBITRATION
8.1 Binding Arbitration
You and Deth-x LLC agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof or the use of the App shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
8.2 Class Action Waiver
YOU AND DETH-X LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
8.3 Governing Law
This Agreement shall be governed by the laws of [YOUR STATE] without regard to conflict of law principles.
9. TERMINATION
9.1 Termination by You
You may terminate this Agreement by deleting the App from your device and discontinuing all use of the App.
9.2 Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the App will immediately cease.
9.3 Effect of Termination
The following provisions will survive termination of this Agreement: Intellectual Property, Indemnification, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution and Arbitration, and any other provision that by its nature should survive termination.
10. RELATIONSHIP BETWEEN DETH-X LLC AND HEX-EVO LLC
Deth-x LLC is a wholly-owned subsidiary of Hex-Evo LLC. All licenses, permissions, and authorizations granted to Deth-x LLC under this Agreement are provided pursuant to Deth-x LLC's operational authority as delegated by Hex-Evo LLC. Notwithstanding the foregoing, Deth-x LLC is the sole party responsible for all obligations, representations, warranties, and liabilities under this Agreement. All claims, causes of action, or disputes arising out of or relating to this Agreement or the App shall be directed solely to Deth-x LLC and not to Hex-Evo LLC or any of its other subsidiaries or affiliates.
11. COMPLIANCE WITH APP STORE TERMS
The App may be subject to additional terms and conditions imposed by third-party app platforms or marketplaces (e.g., Apple App Store, Google Play Store) through which you access or download the App. You agree to comply with all applicable third-party terms and conditions when using the App.
12. MODIFICATIONS TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Agreement.
13. MISCELLANEOUS
13.1 Entire Agreement
This Agreement constitutes the entire agreement between you and Deth-x LLC regarding the App and supersedes all prior and contemporaneous written or oral agreements.
13.2 Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Deth-x LLC.
13.4 Assignment
You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer this Agreement without such consent will be null and void. We may freely assign or transfer this Agreement without restriction.
13.5 Refunds and Goodwill Gestures
Any refunds, reimbursements, credits, complimentary services, public relations gestures, public statements, or other accommodations provided by Deth-x LLC to users are offered purely as a gesture of goodwill or for customer satisfaction purposes. Such actions shall not constitute and shall not be construed as an admission of fault, liability, wrongdoing, or responsibility for any issues, incidents, or claims. Deth-x LLC explicitly reserves all rights and defenses regardless of any such goodwill gestures provided.
